The Town of Oakville Council met in regular session this 19th day of December, 2022 in the Council Chamber of the Oakville Municipal Building, 1225 Trafalgar Road, Oakville commencing at 6:30 p.m.

    3. That a Request for Proposal (RFP) for audit services be issued mid 2027 for the fiscal years ending 2027 through 2031.

    1. That the staff report dated December 6, 2022, entitled September 30, 2022 Financial Results from the Finance department, be received.
    2. That the 2022 capital budget be amended to add a new project (53512202 Parkade Rehabilitation) in the amount of $300,000 funded from the Parking reserve for a consultant to develop rehabilitation plans for repairs required at the downtown parking garage.
    3. That the 2022 capital budget be amended to add $410,000 to project 54412201 Major Vehicle Refurbishment funded from the Capital reserve to cover the higher cost of bus refurbishment based on quotations received.
    4. That the 2022 capital budget be amended to refinance $75,000 from Capital reserve to community benefits charges for project 33102001 Community Benefit Charge and Development Charge Studies.

That staff be authorized to proceed in the appeal to the Ontario Land Tribunal filed by SmartCentres, namely SmartREIT (Oakville II) Inc. and SmartREIT (Oakville) Inc., in respect of applications for Official Plan and Zoning By-law amendments applicable to 256, 260, 294 Hays Boulevard and 271 Oak Park Boulevard, in accordance with the recommendations of the confidential report from the Legal Department dated December 6, 2022.
    2. That staff be authorized to recommend to the Ontario Land Tribunal that intensification on the subject lands is supported.
    3. That the Town Solicitor and the Commissioner of Community Development or designates be authorized to negotiate a settlement of the appeal if the applicant is interested in doing so in accordance with the recommendations of the confidential report from the Legal Department dated December 6, 2022.

    WHEREAS the provincial government passed Bill 23, More Homes Built Faster Act, 2022 on November 28, 2022 with regulations and changes to several provincial acts which will have a significant impact on municipalities in the province;

    WHEREAS the Ontario Big City Mayors (OBCM) consisting of 29 Mayors representing 70 percent of the population of Ontario have thoroughly considered Bill 23; 

    WHEREAS the Town of Oakville having regard for the essential role local municipalities must have in planning for growth and housing supply; and

    WHEREAS the OBCM motion dated Dec 8 articulates the concerns of this Council and our residents;

    THEREFORE, BE IT RESOLVED:

    THAT the Town of Oakville endorses the OBCM letter and request that the Province address the actions requested by OBCM and it’s supporting Municipalities; and

    THAT this endorsement be sent to all Provincial MPPS, Premier Ford, the Association of Municipalities, Halton Regional Council, Ontario Big City Mayors (OBCM) and the Associations of Municipalities of Ontario.

In accordance with Section 14.1(2) of the Procedure By-law, the following Notice of Motion will be considered at the next Council meeting to be held on January 30, 2023:

    WHEREAS the Town of Oakville has declared a Climate Emergency; 

    WHEREAS Election signs that are placed on municipal property are overwhelmingly made with plastics having a negative impact on our environment;

    WHEREAS Election signs have become a visual clutter on our roadways often distracting drivers and causing blight;

    WHEREAS neighbouring municipalities including Burlington, Mississauga, Brampton and the Region of Halton have all banned election signs from the public right of way; 

    WHEREAS election sign bylaws are often broken and enforcement cannot keep up with infractions; 

    WHEREAS section 11 of the Municipal Act, 2001 S.O. 2001 c. 25, as amended authorizes municipalities to pass by-laws respecting signs; 

    WHEREAS subsection 63(1) of the Municipal Act, 2001 S.O. 2001, c. 25, as amended provides that a By-law may prohibit or regulate the placing or standing of an object on or near a highway, and may provide for the removal and impounding or restraining and immobilizing any object placed or standing on or near a highway; 

    WHEREAS Council deems it necessary and in the public interest to regulate election signs; and

    WHEREAS a stand-alone by-law to regulate election signs will help candidates, campaign teams, and the public readily access election sign provisions;

    THERFORE BE IT RESOLVED THAT:

    No person shall display an Election Sign at any location other than entirely on private property; 

    No person shall display an Election Sign on private property without the permission or consent of the owner of the property;

    No person shall display, or permit to be displayed, an Election Sign which is in a state of disrepair so as to be unsafe or unsightly; and 

    THAT staff develop a comprehensive set of rules that ensure signs are installed safely so as not to cause harm or hazard to residents on private property.

    That staff review the Council Appointment to Internal Boards and Committees Procedure and that they report back on options to improve the selection process including:

    1. Opportunities to self-nominate for a placement on a committee as outlined in the current procedure.
    2. That the selections of each Councillor be shared with every member of council by way of a chart (a chart was circulated to all members of council previously to indicate preference and that was submitted for discussion purposes to arrive at the council selection).
    3. That consideration be given to a maximum term of representation on a given committee.
    4. That consideration be given to implementing a maximum and minimum of council appointments (to provide equal opportunity for all Councillors to serve on a particular committee).

    That staff prepare a report to be referred to the 2023 Budget Committee, outlining the Kerr Village Streetscape Christmas lighting and decoration and to consider, as a funding source, any applicable S.37 bonusing funds that may be eligible for the Kerr Village area.

    That staff prepares a report that explores the use of the province’s Community Planning Permit System as a planning tool to help support local priorities while still accommodating growth, including where this has been used in Ontario, its benefits, and where it might be applicable in Oakville as a pilot project.
