If a person or public body would otherwise have an ability to appeal a decision of Oakville Council with respect to an official plan or zoning by-law amendment to the Ontario Land Tribunal, but the person or public body does not make oral submissions at a public meeting or make written submissions to Oakville Council before the proposed official plan amendment is adopted or the proposed zoning by-law amendment is passed, the person or public body is not entitled to appeal the decision. Persons who may otherwise have an ability to appeal an adoption of an official plan amendment or passing of a zoning by-law amendment are limited to persons listed in subsections 17(24) and 34(19) of the Planning Act, respectively.

 

If a person or public body does not make oral submissions at a public meeting or make written submissions to Oakville Council before the proposed official plan amendment is adopted or proposed zoning amendment is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to add the person or public body as a party.

  • Recommendation:

    That the Director of Planning and Development be authorized to grant draft plan approval of the Draft Plan of Condominium (24CDM-24009/1312) submitted by MC Oakvillage CP Inc. and prepared by R-PE Surveying Ltd. dated July 24, 2024, and revised July 27, 2025, subject to the conditions contained in Appendix ‘A’ of the Planning and Development report dated September 9, 2025.

These matters may be considered in the absence of the public under Section 239(2) of the Municipal Act because they deal with:

  • litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board;
  • advice that is subject to solicitor-client privilege, including communications necessary for that purpose
  • information explicitly supplied in confidence to the municipality by the province; and
  • a position; plan, procedure, criteria or instruction to be applied to any negotiations carried on or to be carried on by or on behalf of the municipality or local board.
  • Recommendation:
    1. That the staff report titled “Public Meeting Report – Town-initiated Official Plan Amendment – Provincial Consistency Exercise (File No. 42.15.67)”, be received.

       

    2. That comments from the public with respect to the draft town-initiated Official Plan Amendment (File No. 42.15.67) be received.

       

    3. That staff consider such comments as may be provided by Council.
  • Recommendation:
    1. That the findings of the Bronte Village Streetscape Study and Kerr Village Streetscape Study, as detailed in the staff report dated September 9, 2025, be endorsed; and
    2. That Budget Committee consider the future capital costs of the Bronte Village and Kerr Village Streetscape Studies through the 2026 budget process and identify street improvement priorities for the 10-year capital forecast, and,

    3. That the Bronte Village and Kerr Village Streetscape Studies be implemented through the review and approval of planning and development applications within the Growth Areas, and through the detailed engineering design and construction of subject streets.
  • Recommendation:
    1. That the draft preferred scenario presented in the report titled “Uptown Core Strategic Growth Area Review – Project Update, File No. 42.15.66” be the subject of further public engagement.
